Please read these Terms carefully. They apply whenever you create a Someva account, purchase Foundation, or use the member portal.
These Terms of Service ("Terms") govern your access to and use of someva.health, the Foundation Program, the member portal, and any related materials provided by Someva Health Pty Ltd ("Someva", "we", "us").
By creating an account, purchasing Foundation, or otherwise using the service, you agree to these Terms. If you do not agree, please do not use the service.
Foundation is a structured, educational wellness program centred on gut health, lifestyle, and recovery. It includes written guides, journal materials, video and audio content, member-portal tools, and supplement recommendations.
Foundation is general wellness education, not a substitute for personalised medical advice, diagnosis, or treatment. See section 05.
To purchase or use Foundation, you must:
If you are immunocompromised, taking prescription medications, or managing a diagnosed condition, you should consult your healthcare practitioner before beginning Foundation.
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Foundation is licensed for your personal, individual use; you may not share your login, the program materials, or your member portal access with anyone else.
Notify us at contact@someva.health immediately if you believe your account has been accessed without your permission.
Foundation supports general gut health, gut integrity, digestive wellbeing, and healthy lifestyle behaviours. The associations and research referenced in the program are presented for educational purposes only. This program is not designed to diagnose, treat, prevent, or cure any medical condition or disease.
This program is not suitable for pregnant or breastfeeding women.
Consider consulting your healthcare practitioner before beginning Foundation, particularly if you are immunocompromised, taking prescription medications, or managing a diagnosed condition.
Nothing on someva.health or inside Foundation constitutes medical advice or creates a practitioner–patient relationship. In an emergency, call 000 (Australia) or your local emergency number.
Pricing is displayed in United States Dollars (USD), or the local currency equivalent shown at checkout, and is exclusive of any taxes, duties, or levies that may apply in your jurisdiction. We may change pricing for future purchases; changes will not affect orders already placed.
Payments are processed via Kajabi using a regulated payment gateway. By completing a purchase, you authorise the charge for the price displayed at checkout.
We do not offer refunds for change of mind. Because Foundation gives you immediate access to its full library of program materials at the point of purchase, all sales are final once access has been granted.
Nothing in this policy excludes, restricts, or modifies any consumer guarantees, statutory rights, or non-excludable remedies you may have under the laws of your jurisdiction. If you believe your purchase is faulty, not as described, or fails to deliver what was advertised, email contact@someva.health and we will work with you in good faith to resolve it.

All Foundation materials — including written content, illustrations, audio, video, the Someva name, logo, and brand — are owned by Someva Health Pty Ltd or our licensors and are protected by copyright and trademark law.
Your purchase grants you a personal, non-exclusive, non-transferable licence to use the materials for your own gut-health journey. All other rights are reserved.
Foundation may link to third-party websites, products, or services (for example, supplement suppliers, recipe sources, or research papers). We do not control these third parties and are not responsible for their content, policies, or practices. Your use of any third-party service is subject to that party's own terms.
The service is provided "as is" and "as available". To the maximum extent permitted by law, Someva makes no warranties — express, implied, or statutory — about the service, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except those that cannot be excluded under the Australian Consumer Law.
We do not warrant any specific health outcome from following Foundation. Individual results depend on many factors that are outside our control.
To the maximum extent permitted by law, Someva is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the service.
Where liability cannot be excluded, our total liability is limited, at our option, to either resupplying the service or refunding the amount you paid for it in the 12 months preceding the event giving rise to liability.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you under the Australian Consumer Law and cannot lawfully be excluded.
You agree to indemnify Someva against any claim, loss, or expense arising from your breach of these Terms, your misuse of the service, or your infringement of any third party's rights.
We may suspend or terminate your account if you materially breach these Terms, if your conduct creates risk for other members or for Someva, or if continued provision is no longer commercially reasonable. Where practical, we will give you notice and an opportunity to remedy the issue.
You may close your account at any time by emailing contact@someva.health.
These Terms are governed by the laws in force in New South Wales, Australia. You and Someva submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms or the service.
We may update these Terms from time to time. The effective date is shown at the top of this page. Material changes affecting your rights will be communicated by email to active members at least 30 days before they take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
